Obligations for end sellers

Do you sell (products containing) batteries to end users? If so, there are a number of legal obligations you, as a retailler, must comply with.

What obligations do end sellers have?

Your obligations as an end seller are threefold: you must comply with the take-back obligation, the return obligation and the information obligation.

Take-back obligation

You are required to take back discarded batteries free of charge. Thus, customers must be able to bring in their batteries at your store and this:

  • Without any obligation to make a purchase 
  • Regardless of the chemical family, the brand, or where the battery was purchased
  • Provided that the battery belongs to a battery category that you sell 

You also have an obligation to take back discarded appliances and vehicles with built-in batteries.

Return obligation

You must also return collected, discarded batteries. This means that as soon as you have discarded batteries at your disposition, you are legally obliged to: 

  • Keep them separate 
  • Return them to a recognized collection system, namely Bebat, or to the producer or importer. 
  • The batteries must not end up with other waste and also must not be disposed of through unauthorized channels.

Information obligation

You are required to provide certain information to the end user – your customers. You must inform them about:

  • The battery categories that you take back and the costs incurred by the producer for this
  • The correct, safe, and responsible use of batteries
  • The meaning of the labels and symbols that are visible on batteries

This information must be clear and accessible to the end user at the time of purchase.

Who must comply with these obligations?

Everyone who makes batteries available on the market to end users must comply with these 3 obligations. 

Are you, in addition to being a sales point for batteries, also a producer or importer who makes batteries available on the Belgian market? Then you must also comply with the legal extended producer responsibility.

  • Communicating to consumers via various campaigns;
  • Offering posters to share the required information;
  • Providing a list of Bebat contributions to display at the point of sales.
